A ruling on Oklahoma State pitcher Andrew Oliver’s trial is expected toward the end of January or beginning of February, Oliver’s attorney said Wednesday.
Six days of testimony concluded on Tuesday, and the judge has taken the case under advisement and ordered the two parties to file proposed findings of fact and conclusions of law by Jan. 23. After that he will make a decision within about two weeks.
Once he has ruled on this phase of the case, the judge, Tygh M. Tone of Erie County, Ohio, will schedule the jury trial.
Oliver was suspended last spring, hours before he was scheduled to pitch in a postseason game. After months of legal proceedings, OSU filed an appeal with the NCAA to have Oliver reinstated, and the NCAA restored Oliver’s eligibility and reduced his suspension from the whole season to 70 percent. If the judge rules against Oliver, the latest suspension will stand, and he will have to sit out 50 games this season.
No. 16 OSU’s baseball season opens Feb. 20 in Stillwater.
