Report: OSU’s Oliver suing NCAA

According to a report on Street and Smith’s SportsBusiness Daily’s Web site, Andy Oliver has filed a lawsuit against his former adviser and the NCAA.

The Oklahoma State pitcher hopes to have his collegiate eligibility restored and is also seeking unspecified compensatory and punitive damages, according to the report. NewsPress attempts to reach Oliver were unsuccessful.

Oliver’s ineligibility was announced May 31, hours before he was scheduled to pitch against Wichita State in the winners’ bracket of the NCAA Stillwater Regional.

The suit, which was filed in Erie County, Ohio, alleges breach of contract, constructive fraud, negligence and defamation against Robert Baratta, Oliver’s former adviser. According to the report, Baratta was fired by Oliver, who then hired Scott Boras as his new adviser.

The SportsBusiness Daily reports Baratta submitted a bill of $113,775 for services rendered.

According to the report, Richard Johnson, Oliver’s attorney, said Baratta turned Oliver in by writing a letter to Rachel Newman Baker, the NCAA’s director of agent, gambling and amateurism activities.

SportsBusiness reports that in Baratta’s letter, he alleges Oliver told him Boras offered baseball equipment and private pitching lessons.

According to the report, the lawsuit alleges the NCAA didn’t give Oliver due process, used privileged attorney-client information that was illegally obtained against him, and failed to complete its investigation before he was suspended.

In the report, Andrew Entwistle, Baratta’s attorney, referred to the suit as a “wholly frivolous piece of litigation.”

Oliver, a soon-to-be junior, was OSU’s ace last season and went 7-2 with a 2.20 ERA, the third-lowest in the Big 12. He tied with Missouri’s Kyle Gibson for third in the conference with 96 strikeouts and was named a first-team All-Big 12 selection. Opponents hit just .211 against him.

In addition, Oliver was recently named to the U.S. National Baseball Team along with teammate Tyler Lyons. During the Trials, the Vermilion, Ohio, native made three appearances and recorded 10 strikeouts in nine innings and led the squad to a 9-3 mark.

Add a class action suit for all of us for pain and suffering.

I'm so glad to see this. Hopefully, it means he has been cleared to play by the NCAA.

Anon, I wouldn't mind being part of that class action. Due to the timing, something still stinks...wonder what, if any, telephone calls moved between barratta(sp?) and Kansas?

Obviously, Andy, the team, and Coach Anderson were hurt the most by this incredible turn of events.

But, we fans who followed baseball all year long had something stripped from us that we cannot get back either.

IF all this turns out to be what we suspect, that the agent was just trying to get Andy back for changing advisors, then something needs to be done and I don't mean a slap on the wrist. That agent/advisor needs to lose his license, if there is such a thing. Apparently, it was his timing to inflect the greatest amount of payback possible.

IF the NCAA jumped the gun and made this ruling without investigating or talking to Andy at all, and it turns out to be false accusations, then the NCAA should be held responsible for the loss for Andy, his teammates, Coach Anderson who put together this remarkable group of players, and to all of us who had our hearts ripped out.

We'll see what happens. If it was all false accusations, I hope OSU files suit against the NCAA for lack of institutional control of themselves.

We could award ourselves 10 extra scholarships at the NCAA's expense each year for 5 years, and they could finance our new ballpark. We could name the ballpark the Andy Oliver NCAA Stinks Ballpark. Just kidding, sort of.

Unfortunately, I think it was OSU who suspended Andy BECAUSE the NCAA called with this allegation and OSU was too skittish to stand their ground and say PROVE IT FIRST. The NCAA is guilty of gossip mongering to the highest degree and OSU is guilty of having no ****s. Still I am glad Andy brought the suit and I wish him all the luck in the world.

I agree with you on this Anonymouscowgirl.

I dont know about you all but i think osu needs to stand up to the ncaa because if this was uo or usc Oliver would not gotten the shaft.

if there were any orginazation that deserved to be sued its the clueless ncaa .

there is an established appeal process.

you got that right Cal, the sanctions against us from the Jim Stanley days, some lady said Bum Phillips was in her living room offering her son money, we proved Bum not even in the state, but it held.

now nothing was said about Wade Phillips being in her living room

...and we "know" that Brent Blackman, Joe Coyle, etc. were all paying "full rent" while living at Forty North. I'm sure that Gip Duggan getting nailed with Clarence Wright, etc. had to be a conspiracy.:cool-smiley-027:
