Report: OSU’s Oliver suing NCAA

According to a report on Street and Smith’s SportsBusiness Daily’s Web site, Andy Oliver has filed a lawsuit against his former adviser and the NCAA.
The Oklahoma State pitcher hopes to have his collegiate eligibility restored and is also seeking unspecified compensatory and punitive damages, according to the report. NewsPress attempts to reach Oliver were unsuccessful.
Oliver’s ineligibility was announced May 31, hours before he was scheduled to pitch against Wichita State in the winners’ bracket of the NCAA Stillwater Regional.
The suit, which was filed in Erie County, Ohio, alleges breach of contract, constructive fraud, negligence and defamation against Robert Baratta, Oliver’s former adviser. According to the report, Baratta was fired by Oliver, who then hired Scott Boras as his new adviser.
The SportsBusiness Daily reports Baratta submitted a bill of $113,775 for services rendered.
According to the report, Richard Johnson, Oliver’s attorney, said Baratta turned Oliver in by writing a letter to Rachel Newman Baker, the NCAA’s director of agent, gambling and amateurism activities.
SportsBusiness reports that in Baratta’s letter, he alleges Oliver told him Boras offered baseball equipment and private pitching lessons.
According to the report, the lawsuit alleges the NCAA didn’t give Oliver due process, used privileged attorney-client information that was illegally obtained against him, and failed to complete its investigation before he was suspended.
In the report, Andrew Entwistle, Baratta’s attorney, referred to the suit as a “wholly frivolous piece of litigation.”
Oliver, a soon-to-be junior, was OSU’s ace last season and went 7-2 with a 2.20 ERA, the third-lowest in the Big 12. He tied with Missouri’s Kyle Gibson for third in the conference with 96 strikeouts and was named a first-team All-Big 12 selection. Opponents hit just .211 against him.
In addition, Oliver was recently named to the U.S. National Baseball Team along with teammate Tyler Lyons. During the Trials, the Vermilion, Ohio, native made three appearances and recorded 10 strikeouts in nine innings and led the squad to a 9-3 mark.
