STILLWATER — Oklahoma State football player Brandon Dennard Pettigrew appeared in Payne County District Court on Monday on charges of assault and battery on a police officer and public intoxication stemming from a January incident at a Stillwater residence.

Pettigrew, 23, was ordered Monday by Special District Judge Phillip Corley to return to court May 19 on the two-count charge, to which he has pleaded not guilty, Deputy Court Clerk Rhonda Bagwell said. Pettigrew remains free on $5,000 bond.

If convicted of the felony count accusing him of hitting Stillwater Police Officer Paul Priegel on the chest with his elbow with the intent to injure the officer, Pettigrew could receive as much as a five-year prison term and a $500 fine.

If convicted of the public intoxication misdemeanor count, Pettigrew could receive as much as a 30-day jail term and a $100 fine.

Pettigrew was the only person arrested when three Stillwater police officers were sent to a report of a fight in progress between 10 to 15 people about 1:20 a.m. Jan. 20 at a residence in the 2300 block of North Dryden Street, police spokesman Dale Higgins said.

The 6-foot-6, 260-pound Pettigrew was given numerous opportunities by police to leave, Higgins said. “He refused to cooperate. They decided to arrest him for public intoxication. He elbowed one of the officers,” Higgins alleged.

Five year prison term and a $500.00 fine? Those penalties seem a little disproportionate. I mean, you'd think 90 days and a 500 buck fine, or 5 years and a 50k fine.

Either way, if convicted he is a felon and probably off the team.

At least it is not a sex crime with a 12 year old. If other police witnessed the elbow he is screwed. I am surprised his attorney did not try for a no contest plea bargain deal with probation.

Yep.

I've seen 'em happen in the first row of seats behind the rail in the court room on the day of trial.

I'm sure some of the lawyer types here have also.
