Deputy sentenced in incident involving tainted sandwich

Joseph Cantwell appears in court today.A fired deputy will be on probation for five years for feeding a tainted sandwich to a prisoner in the Franklin County jail.

Joseph M. Cantwell, 38, of Lewis Center in Delaware County, admitted violating state health codes as part of a plea deal today in Franklin County Environmental Court. He could have been sent to jail for up to 90 days but will avoid that if he completes probation without incident.

Cantwell was fired by Sheriff Jim Karnes in May because he fed a bologna sandwich to an inmate that had been wiped against another inmate's penis. He and another deputy photographed the February incident in the Downtown jail.

Joseph Copeland - the prisoner who ate the sandwich - and two other prisoners have now sued the county.

Assistant City Prosecutor Lara Baker dismissed two more-serious charges of dereliction of duty and disorderly conduct in exchange for guilty pleas to the health-code violations, which specify how food is to be served in a state-run institution such as a jail.

"It was grossly inappropriate behavior from someone who works in the Franklin County jail," Baker said, noting that Cantwell had no criminal record and lost his job.

Environmental Court Judge Harland H. Hale also fined Cantwell $500.

Cantwell apologized, saying, "I'm really heartfelt sorry for the shame and embarrassment I caused and everyone linked to this incident, especially my fellow deputies and the sheriff."

His attorney, Jonathan Tyack, said Cantwell cannot appeal the sentence and is not working.

"It was blown out of proportion and it was a prank," Tyack said, "but I also understand why people are upset."

"Tainted" is an interesting word selection for this situation.

I'm assuming there was no provable rot or decay. The sandwich could not have been considered fresh by any means. You could certainly compare it to one that had been picked up after being dropped on the floor. The only real harm was the psychological harm in telling the inmate where it had been immediately before he consumed it. If the little funny had been kept to themselves and they had not laughed in his face, there would have been no harm to report.

The problem with most meanness is that it has to be shared with the victim or published to others.

YA THINK??? Jeeze. Whatever charge I was in Jail for may have had to been expanded to murder.

This headline is wrong.

It wasn't tainted.

It was penised.

It doesn't sound to me like he rubbed it far enough back for it to be "tainted", but I haven't seen the picture.
